Arztvorbehalt
The German term “Arztvorbehalt” refers, in general, to certain measures that may exclusively be carried out by physicians. Thus, the Genetic Diagnostics Act stipulates that genetic testing for diagnostic purposes must be performed by physicians (§ 7 (1)). Predictive genetic tests may actually exclusively be conducted by medical specialists (“Facharztvorbehalt”), such as human geneticists or other specialists who have obtained a special qualification in genetic testing. Genetic analysis of genetic samples must be carried out by the physician in charge or a person or institution mandated by this physician (§ 7 (2)). The activity of genetic counselling, in the terms of § 10, is also reserved exclusively to physicians (§ 7 (3)).
